Guest Agreement
Important: Please read this agreement carefully before creating an account. TheHouseStay is a free online platform intended only to introduce hosts and guests to one another. TheHouseStay is not the owner, operator, manager, agent, broker, travel agency, hotel, homestay operator, payment intermediary or guarantor of any property, host, guest, stay, transaction or representation.
1. Nature of the Platform
TheHouseStay provides a technology platform on which hosts may publish information about homestay accommodation and guests may discover and contact hosts. TheHouseStay does not itself provide accommodation and does not enter into the accommodation contract between a host and a guest.
2. Independent Verification — Essential
Every host and guest is responsible for independently checking the identity, contact details, ownership/authority, property, photographs, location, amenities, price, availability, permissions, safety, suitability, legal compliance and all other representations of the other party before proceeding. A profile, phone number, photograph, document, review or listing on TheHouseStay must not be treated as proof of authenticity or correctness.
3. No Guarantee or Endorsement
TheHouseStay does not guarantee the accuracy, completeness, reliability, legality, quality, safety, security, availability or suitability of any listing, host, guest, property, price, photograph, review or communication. Listing a property or allowing an account to exist does not constitute an endorsement, certification, verification or recommendation by TheHouseStay.
4. Direct Contact and Direct Dealings
TheHouseStay may allow hosts and guests to exchange telephone numbers, WhatsApp details, email addresses and other contact information directly. Any communication, negotiation, booking, payment, cancellation, deposit, refund, check-in, stay, dispute or other dealing between a host and guest is undertaken independently between those parties.
5. No Payment or Booking Protection
TheHouseStay does not collect or hold accommodation payments, deposits or security amounts under this free platform model and does not provide escrow, payment protection, refund protection, cancellation protection or insurance. Users must independently decide whether and how to pay another party and should use appropriate caution before transferring money.
6. Safety and Personal Caution
Users should meet or communicate safely, avoid sharing unnecessary sensitive information, verify identity and property details, inspect the property where appropriate, confirm emergency arrangements, and use their own judgement before travelling or allowing another person into a property. Do not rely solely on information displayed on TheHouseStay.
7. Host Responsibilities
Hosts must provide truthful and lawful listing information, use photographs/content they are entitled to use, set prices and availability accurately, disclose material restrictions or conditions, maintain the property in accordance with applicable law, and obtain any licences, registrations, permissions, approvals or consents required for their property and locality. Hosts are solely responsible for their accommodation, representations, conduct and dealings with guests.
8. Guest Responsibilities
Guests must provide truthful registration information, respect property rules, use the accommodation lawfully, communicate honestly, verify the host/property independently, and remain responsible for their own conduct, belongings, travel arrangements and decisions.
9. No Liability for User-to-User Dealings
To the maximum extent permitted by applicable law, TheHouseStay shall not be responsible for losses, injuries, theft, fraud, misrepresentation, property damage, disputes, cancellations, non-availability, unsafe conditions, unlawful conduct, payment disputes, communications or any other consequence arising from dealings between users. Nothing in these terms excludes liability that cannot lawfully be excluded.
10. User Content and Accuracy
Users are solely responsible for the content they publish or send. TheHouseStay may remove, restrict or suspend content or accounts that appear misleading, unlawful, unsafe, abusive, fraudulent or inconsistent with these terms.
11. Reporting and Cooperation
Users should report suspected fraud, impersonation, unsafe accommodation, harassment, illegal activity or misleading listings to TheHouseStay. TheHouseStay may investigate, preserve information where legally appropriate, restrict accounts or listings, and cooperate with competent authorities where required.
12. Privacy and Contact Information
By registering, users acknowledge that TheHouseStay may process the personal information necessary to operate accounts, publish listings, facilitate user-to-user contact, provide support, prevent abuse and comply with law, subject to the site's Privacy Notice and applicable data-protection requirements. Users should not publish another person's personal information without appropriate authority.
13. Free Platform
The platform is provided without a booking commission or accommodation transaction fee under the current model. TheHouseStay may change features, suspend services or introduce future paid services with appropriate notice and updated terms.
14. Acceptance
By ticking the acceptance box during registration and creating an account, you confirm that you have read, understood and accepted these terms, that you will independently verify the other party and all material facts before dealing with them, and that you understand TheHouseStay is only a free introduction and communication platform.
